Advertising - Shopgood Fireworks

This year, the Minister has decided that the purchase of Shopgoods Fireworks is permitted only on 1 July 2008.

Retailers are unable to sell shopgood fireworks, offer or expose shopgood fireworks for sale or take pre orders/pre sales prior to this date. Shopgood fireworks cannot be displayed in a retail shop prior to 1 July 2008.

Advertising is permitted prior to 1 July 2008.

Question Answer
Can I advertise the sale of shopgood fireworks? Yes. As long as you are not physically exposing shopgood fireworks to a consumer.
Why was I told to wait? Under the Dangerous Goods legislation the definition of ‘sell’ includes expose for sale. NT WorkSafe has sought legal clarification on whether ‘expose for sale’ included advertising. It is confirmed that advertising is not caught within this definition.
When can I advertise? Any time as long as you are not physically exposing shopgood fireworks to a consumer or taking pre sales or pre orders.
When can shopgood fireworks be sold to the public? Retailers must have an approved permit from NT WorkSafe to sell shopgood fireworks on 1 July 2008 - Territory Day only.

Fireworks testing assessors

All shopgoods fireworks must be tested by an NT authorized shopgoods fireworks assessor to the satisfaction of the Competent Authority (NT WorkSafe) prior to importation into the Northern Territory.

Documentation of the testing as per AS2187.3 must be provided to NT WorkSafe as evidence of each fireworks item's safety performance prior to 9 May 2007. This includes passed and failed test reports on all fireworks.

NT WorkSafe has developed the attached database as an electronic template for testing fireworks. It is recommended that importers and assessors use the electronic format provided, as this will assist faster processing of an import/export application.

The Fireworks Database User Manual has full instructions on how to use the database, so it is recommended that authorized shopgoods fireworks assessors print this document and read it prior too downloading the necessary database and files.

Wholesalers

NT WorkSafe will again be active in ensuring public safety in the lead up to Territory Day 2008 celebrations.

Applications to wholesale fireworks for the 2008 Territory Day will not be accepted after Friday 9 May 2008. Applications are to be lodged at the Territory Business Centres.

Past wholesalers for shopgoods fireworks must print the following documents and read through them as there have been changes to NT WorkSafe's bulletins, checklists and application forms.

Retailers

To ensure the safe use and storage of shopgoods fireworks for Territory Day celebrations, the sale of fireworks in the Northern Territory is closely regulated.

If you are considering selling shopgoods fireworks for Territory Day this year, you must be aware of your legal obligations when doing so.

You may not sell fireworks to intoxicated persons. You may not sell fireworks to persons under the age of 18 years. You must obtain a licence to possess, store and sell shopgoods fireworks. This licence must be obtained prior to taking delivery of your fireworks.

Retailers for shopgoods fireworks must print the following documents and read through them. NT WorkSafe’s bulletins, checklists and application forms have had updates to them since 2008.

Display Fireworks

Display fireworks are strictly prohibited for transport, storage and sale with shopgoods fireworks.

Fireworks of a purely explosive type are strictly prohibited and are not to be stored, possessed, supplied or sold with shopgoods fireworks. These explosive type fireworks (eg "Bangers" [firecrackers], 1"- 4" shells, sky-rockets) are categorised as display type fireworks and a displays licence and a fireworks display permit are required to be issued by NT WorkSafe.
